What Federal Gun Charges Carry Mandatory Minimum Sentences?

Certain federal firearm offenses trigger automatic prison time, and no matter what the judge wants to do regarding your sentence, they often can’t go below a certain number of years in prison. Below are the main federal gun charges that carry these mandatory minimum penalties: 

Possession of a Firearm in Furtherance of a Drug Trafficking or Violent Crime 

This is the most common federal charge with automatic prison time built in. You get a 5-year minimum sentence just for possessing the gun in furtherance of a drug or violent crime. If the gun is “brandished” (shown or used to threaten), the minimum rises to 7 years. If it is discharged (fired), the minimum is 10 years. Any mandatory time on a § 924(c) charge must run consecutively to any other sentences, stacking your time in prison.
